Personal injury claims on rise

New figures have revealed that the number of personal injury claims has risen again despite attempts to regulate claims-handling companies.

Legal information provider Sweet & Maxwell has released statistics which show that the number of personal injury claims started in the High Court went from 914 in 2006 to 1,205 in 2008 – a jump of 31.8%.

The rise comes despite a Government reform of the legal system which tried to cut down the number of claims being made. The Compensation Act 2006 introduced new registration requirements for claims management companies and also set up the Claims Management Services Regulator to monitor the industry.

A Sweet & Maxwell spokesperson said: “Financial stress has meant that some individuals will have submitted personal injury claims – including perfectly legitimate claims – which they might not normally have been motivated enough to pursue.

“Meanwhile, insurers suffering from weak returns from their investments may be more willing to contest a claim that they feel has no merit.”
