A young girl, who cannot be identified for legal reasons, has won a successful medical negligence claim against the Ipswich Hospital NHS Trust after being born with a life-affecting disability. The 11-year-old was left with brain damage following being starved of oxygen in the womb. She has acute cerebral palsy, which affects her speech and mobility.

Cerebral palsy is a general term for a number of neurological conditions caused by problems in the brain and nervous system. The condition manifests itself in different ways but fundamentally affects a sufferer’s movement and co-ordination and occurs if the brain develops abnormally, or is damaged before, during or shortly after birth.

During the course of her birth, the girl was suffering from difficulties in the womb. While doctors monitored her condition, they failed to pick up on vital indicators that the baby was suffering from a lack of oxygen. A lack of oxygen to the brain is a common cause of brain damage in infants and with doctors failing to spot the signs that the baby was in trouble, the girl was subject to a delay in her delivery by caesarean section.
