Law Commission publishes paper as part of project on Charity Law

After publishing the first part of its review in September 2014 (which largely covered social finance), the Law Commission covered the remainder of the issues in a 300-page document released on 20th March. The majority of the areas reviewed follow directly from the issued raised by Lord Hodgson during his review of the Charities Act 2006. The suggestions include:

  • Giving charities more flexibility to spend permanent endowment;
  • Reducing the obligations on a charity when selling charity property;
  • Making it easier for charities established by Royal Charter to amend their Constitutions;
  • Extending the ability of charities to pay trustees for the supply of goods (as well as services); and
  • Dealing with legacies where a charity has merged.

It is unclear which of these suggestions will make it into future legislation. The Charity Law Association has set up a working party on the new paper to respond to the thorough and extensive consultation.
