Profile

Tim is a member of the IBB Charities Team.  Whilst Tim's background is in dispute resolution, he has experience across a wide range of complementary practice areas that are relevant to activities of charities, organisations and corporations:

• advising Trustees of charities on issues arising out of the their day to day administration including advising charities on mitigation of commercial and contractual risks
• dispute resolution (including contractual disputes, civil fraud, injunctions, commercial litigation, shareholder disputes, contested probate and Trustee disputes)
• the formation and incorporation of charities
• advising in relation to Charity Commission investigations acting for Trustees and former Trustees of relevant charities
• liaising with the Charity Commission to obtain appropriate Orders and Schemes for clients
• advising on insolvency issues (both personal and commercial)
• mediation (acting as either the Mediator or for the parties in a mediation)

Tim is specialised in providing strategic focussed advice to his clients to enable them to achieve their objective in the most effective manner. 

Recent Projects

• the incorporation of several charities previously regulated by a trust deed and arranging for the charity to be registered with the Charity Commission and the Office of the Scottish Charity Regulator
• advising on a regulatory investigation on behalf of the Health and Safety Executive
• advising on several serious incidents relating to internal frauds
• arranging a composite loan and gift from a religious charity to a private school charity in order to enable it to replace its existing rundown gym and swimming pool
• advising on issues relating to hybrid common investment funds and pooling schemes
• acting as a member of the appeal panel in relation to appeals by several members of staff of a charity following their dismissal
