Who can claim?
- Spouses and Civil Partners of the deceased, including those who have divorced or separated;
- Those who have cohabited with the deceased for a period of at least two years prior to their death;
- Parents, locum parents, or other dependants of the deceased;
- Children or other dependants of the deceased; and
- Administrator or Executor of the deceased estate.
What can you claim for?
- An amount for the pain and suffering of the deceased (if there was suffering prior to the fatality);
- Repayment of actual losses, such as funeral expenses;
- A bereavement award for the deceased’s spouse or parents; and
- A dependency award, in some circumstances, for the deceased’s children.
The claim must be of a pecuniary nature, unfortunately no awards for the emotional suffering that will undoubtedly follow the loss of the deceased, can be made.
When should you claim?
A claim in these circumstances must be brought within 3 years of the date of death, or within 3 years from the date of the personal representative’s knowledge of the same, whichever is later. Failure to bring a claim within the time period will result in it being "statute-barred" and prevent a claim being brought against the alleged wrongdoer.
