Fatal Accidents

When such tragic accidents happen to the ones we love the impact can be both devastating and widespread.

As with all personal injury claims, it would need to be established that the fatal accident was caused as a result of the negligence of a third party.

Fatal Accident claims can be complex; however, our solicitors and fee earners have extensive experience in this area and can offer the advice and support you need to help you through the process of making a claim.

Who can claim?

  1. Spouses and Civil Partners of the deceased, including those who have divorced or separated;
  2. Those who have cohabited with the deceased for a period of at least two years prior to their death;
  3. Parents, locum parents, or other dependants of the deceased;
  4. Children or other dependants of the deceased; and
  5. Administrator or Executor of the deceased estate.

What can you claim for?

  1. An amount for the pain and suffering of the deceased (if there was suffering prior to the fatality);
  2. Repayment of actual losses, such as funeral expenses;
  3. A bereavement award for the deceased’s spouse or parents; and
  4. A dependency award, in some circumstances, for the deceased’s children.

The claim must be of a pecuniary nature, unfortunately no awards for the emotional suffering that will undoubtedly follow the loss of the deceased, can be made. 

When should you claim?

A claim in these circumstances must be brought within 3 years of the date of death, or within 3 years from the date of the personal representative’s knowledge of the same, whichever is later. Failure to bring a claim within the time period will result in it being "statute-barred" and prevent a claim being brought against the alleged wrongdoer.
