Rehabilitation
If you have been injured as a result of another party’s negligence, you may be able to make a claim for compensation. This will result, if successful, in damages being paid to you for your injury and losses incurred as a direct result of the accident.
However, one of the key aims of the protocol which governs personal injury claims is to promote the early use of rehabilitation and early intervention in the process so that the injured party makes the quickest recovery, regardless of the type of injury suffered. Early intervention of rehabilitation care for victims of personal injury is paramount.
Today, under the Rehabilitation Code 2007, the immediate quality of life for the claimant is one of the first and foremost issues to be addressed by lawyer and insurer jointly.
The code aims to ensure that if rehabilitation is likely to be of benefit to a person who has sustained the injury then it is important to notify the insurer of the other party at the earliest opportunity.
If it is required, both parties will agree to instruct a rehabilitation company or medical expert to comment on the rehabilitative needs of the injured party. This is paid for by the insurer. This is carried out by either a medical expert or by way of an immediate needs assessment. This can be by a formal interview in the injured party’s home or over the telephone.
Both sides receive the report and the work of the rehabilitation company is separate from the compensation claim. The information gathered and the reports and opinions obtained cannot be used in the compensation claim.
Following the assessment, various recommendations will be made. If the parties agree them, the recommendations will be implemented to assist the injured party’s recovery.
It is hoped that with rehabilitation the injured party will be able to recover sooner and be able to return to their pre accident level.
The rehabilitative needs of the injured party will continue throughout the claim and will continue to be monitored.
