Judicial Review of the CAGE Decision: Did the Charity Commission Act Outside Its Powers?

CAGE, an independent advocacy organisation that campaigns against the War on Terror, has been given permission to bring a Judicial Review against the Charity Commission. Following public outcry after statements made by a CAGE representative about ‘Jihadi John’ earlier this year, the Charity Commission approached a number of charities who had funded CAGE in the past to ensure they did not fund the organisation again. Despite the High Court dismissing CAGE’s argument that the Commission breached its human rights and did not act fairly, it has granted CAGE permission to appeal to consider whether the Commission acted ‘ultra vires’ (outside its powers) in seeking assurances from funding organisations. We await this hearing with interest, which should give further clarity to the scope of the Commission’s powers.
