Reform of Personal Injury Claims Announced by Ministry of Justice

The Ministry of Justice has published its Business Plan for 2011-2015, during which time the Government will reform the justice system by turning government on its head. The business plan covers a range of issues, including criminal and family justice, rehabilitation and civil litigation.

There is a clear time frame, which includes a review of Lord Jackson’s civil litigation and cost proposals. That begins in November with consultation ending in March 2011. If necessary, legislation will be introduced at that time to bring about the changes sought.

There is also a proposal to extend the current procedures for dealing with low value road traffic accident claims to other areas of personal injury, including clinical negligence. The consultation for such changes will broadly take place over the same period, with the final report planned for October 2011.
