Commission seeking a general power to disqualify trustees

The Commission has requested that it be given a general power to disqualify trustees, to improve the Commission’s ability to disqualify individuals it suspects of wrongdoing from acting as a trustee of any charity. This would mean that instead of trustees resigning pre-emptively when the Commission starts the process to remove them from office (thereby leaving them free to act as trustees for another charity) the Commission would use a general power of disqualification to stop such persons from serving as a trustee of any charity. The Commission has also signalled that it wishes to look at whether to preclude those who have been convicted of other offences from serving as charity trustees.
